Anti-Spam Policy

1. Purpose and Scope

This Global Anti-Spam Policy sets out the standards and procedures governing the sending of Commercial Electronic Messages (“CEMs”) by or on behalf of learningtheimway.com

This Policy applies globally to all CEMs transmitted using our systems, services, websites, and related digital properties, including learningtheimway.com and to all employees, affiliates, contractors, vendors, and marketing partners.

2. Definitions

2.1 Commercial Electronic Message (CEM)

A Commercial Electronic Message means any electronic communication (including email, SMS, social media direct message, or other electronic format) that promotes, advertises, or offers to sell or lease a product, service, business opportunity, or investment, whether directly or indirectly.

2.2 Consent

  • Express Consent: Voluntary, specific, informed, and verifiable agreement from an individual to receive CEMs. Express consent requires an active, opt-in action (e.g., checking a consent box or submitting an email address in a form clearly labeled for subscription).
  • Implied Consent: May exist only where legally permitted (e.g., an existing business relationship) and only for the period allowed under applicable law.
  • Revocation of Consent: Recipients may withdraw consent at any time by submitting an Unsubscribe Request.

2.3 Unsubscribe Request

An Unsubscribe Request means a clear indication by a recipient that they no longer wish to receive CEMs from the Company. Such requests may be made by clicking an unsubscribe link or replying to an email with a clear unsubscribe instruction.

3. Consent Requirements

  • All CEMs must be sent only to recipients who have provided express opt-in consent.
  • Consent must be obtained through transparent mechanisms clearly explaining:
    • Who is seeking consent
    • The specific nature and frequency of messages to be sent
    • The ability to withdraw consent at any time
  • Pre-checked boxes, passive opt-ins, or bundled consents are strictly prohibited.
  • All records of consent must be maintained for a minimum of five (5) years and be available for regulatory audit or recipient inquiry.

4. Unsubscribe Compliance

  • Each CEM must include a functional and clearly visible unsubscribe mechanism, which must:
    • Be free of charge
    • Be valid for at least 60 days from message transmission
    • Allow for electronic submission (e.g., link, reply, or form)
  • Unsubscribe Requests must be honored within five (5) business days of receipt.
  • Once unsubscribed, the recipient’s address must be placed on a perpetual suppression list, ensuring no further communications are sent from our systems or affiliates.

5. Message Content Requirements

Every CEM sent by or on behalf of learningtheimway,com must comply with the following standards:

  • The “From,” “Reply-To,” and “Return-Path” fields must accurately identify the sender and must not mislead recipients as to the source or identity of the sender.
  • The “Subject” line must accurately reflect the content of the message and may not contain deceptive or manipulative language.
  • The message body must clearly identify the sender as Learning The IM Way and include the Company’s valid physical mailing address: 32 Abbey Walk Mobile Home Park, Bootham Lane, Dunscroft, Doncaster, South Yorkshire, England
  • A clear and prominent unsubscribe mechanism must be included in every message.

6. Prohibited Conduct

Under this Policy, the following actions are strictly prohibited:

  • Sending unsolicited CEMs without prior express consent.
  • Using misleading, falsified, or deceptive routing information or subject lines.
  • Harvesting, scraping, or purchasing email addresses without explicit documented consent.
  • Using third-party mailing services or affiliates who fail to comply with this Policy.
  • Concealing or misrepresenting transmission origins or sender identity.

7. Record-Keeping and Audit Trails

To ensure compliance and accountability, the Company maintains comprehensive records for each CEM campaign, including:

  • Date and method of consent collection
  • IP address, form source, and timestamp of consent
  • Message content, subject line, and transmission logs
  • Opt-out dates and suppression list updates
  • Periodic audits verifying ongoing compliance

Records must be retained for no less than five (5) years and be accessible for internal and regulatory review.

8. Third-Party Mailings and Affiliates

  • The Company may use third-party service providers or affiliates to distribute communications; however, such parties must contractually agree to comply with this Policy and all applicable anti-spam laws.
  • The Company disclaims all liability for non-compliant activity by independent third parties, affiliates, or advertisers that operate outside our direct control.
  • Any complaints regarding third-party messages referencing Learning The IM Way should be reported immediately to stuart@learningtheimway.com for investigation.

9. Enforcement and Reporting

Violations of this Policy by employees, contractors, or affiliates may result in disciplinary action, termination of access, or legal proceedings.

All reports will be investigated promptly and appropriate corrective measures will be taken.

10. Severability

If any provision of this Policy is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect to the maximum extent permitted by law.

11. Governing Law and Jurisdiction

This Policy shall be governed by and construed in accordance with the laws of England and Wales, without regard to conflict of laws principles.

Any disputes arising from or relating to this Policy shall be subject to the exclusive jurisdiction of the courts located in England.

12. Policy Updates and Revision Log
